From Arkansas comes a proposed class and collective action in which the plaintiff, a former server, claims the operators of Little Rock’s P.F. Chang’s China Bistro failed to pay appropriate wages. The plaintiff claims that although servers’ wages were subject to a tip credit, the workers spent more than 20 percent of their time performing non-tipped tasks, such as opening and closing the restaurant and rolling silverware. Because of this, the case says, the defendant should have paid servers at least the $7.25 federal minimum wage, and not the tipped worker minimum wage.
