The operators of Lighthouse Fish Market & Restaurant in New York have been hit with a proposed collective action filed by a former employee who says he wasn’t paid properly while working for the defendants as a food preparer.
The operators of Lighthouse Fish Market & Restaurant in New York have been hit with a proposed collective action filed by a former employee who says he wasn’t paid properly while working for the defendants as a food preparer. The plaintiff was reportedly employed at the restaurant between January 2015 and March 2016 and received a fixed weekly salary of $600 for approximately 91 hours of work per week. According to the lawsuit, his wages, when divided by his hours worked, fell below the required minimum and did not include time-and-a-half premium pay for his overtime hours nor extra pay when he worked more than 10 hours in a day. Furthermore, the case claims the plaintiff was often required to work beyond his scheduled hours without being paid for the additional time he put in.
The suit later argues that the defendants neglected their obligation to provide employees with accurate wage statements and notices detailing their rights under state and federal labor law.
