LG Electronics U.S.A., Inc. and the company’s president have been named as defendants in a proposed collective and class action lawsuit wherein a manager alleges she was cheated out of overtime pay and subjected to a hostile work environment.
LG Electronics U.S.A., Inc. and the company’s president have been named as defendants in a proposed collective and class action lawsuit wherein a manager alleges she was cheated out of overtime pay and subjected to a hostile work environment.
The plaintiff began her employment as a non-exempt associate in the defendants’ accounts receivable department and has since been promoted to a manager exempt from overtime wages, according to the case. The suit charges that the defendants manufacture the appearance of a hierarchy within the company by promoting workers without adjusting their responsibilities. Consequently, the plaintiff claims she holds no real authority as a manager and that her judgments and recommendations are “never given any weight.” Thus, the plaintiff’s status as an exempt employee is inaccurate, the case argues, and she should have received time-and-a-half wages for overtime work.
Further, the case adds that workers with actual authority are “unrestrained” from making derogatory and discriminatory remarks to the plaintiff and other workers. Specifically, the suit says the plaintiff’s supervisors have demanded that she serve their lunch and expected her to perform certain tasks based on her gender. The woman is currently on disability leave “due to the stresses caused by the unlawful acts of Defendants,” the suit says.
