A collective action filed in New York claims the bagel-centric eatery failed to pay mandatory time-and-a-half overtime wages.
A proposed collective action has been filed in New York on behalf of people who within the last three years worked for Let There Be Bagels, PW, Inc. and its owner/operator and who were allegedly not paid proper wages. The plaintiff in the suit claims he was paid in cash a base salary of between $650 and $750 per week, regardless of the number of hours worked. The plaintiff claims he and other potential class members regularly worked more than 40 hours per week and never received time-and-a-half wages for their extra hours. The suit also alleges the defendants violated state law when they failed to keep proper payroll records and failed to furnish written notice of pay rates to their employees.
