Lawsuit: The Sales Staff Illegally Caps Employees’ Wages

Three former employees have filed suit against The Sales Staff LLC and four individual owners alleging that they failed to pay their inside sales employees proper wages.
Three former employees have filed suit against The Sales Staff LLC and four individual owners alleging that they failed to pay their inside sales employees proper wages. The plaintiffs claim the nature of the company’s “intensely competitive culture” and “challenging sales quotas” required them to work more than 40 hours per week. They argue, however, that the defendants failed to pay them any wages at all for the hours they worked above 40, in violation of the Fair Labor Standards Act. Additionally, two of the plaintiffs say they received no compensation for the last few months of their employment.
The suit seeks to cover the following proposed class and collectives:
“The FLSA Overtime Collective Members are all of Defendants’ current and former Inside Sales Representatives who earned an hourly wage with commission incentives, who worked for Defendants at any time starting three years before this lawsuit was filed up to the present.”
“The FLSA Minimum Wage Collective Members are all of Defendants’ current and former employees who did not receive at least one paycheck for work performed at any time starting April 1, 2017 through the present.”
“The Arizona Class Members are all of Defendants’ current and former Arizona employees who did not receive at least one paycheck for work performed at any time starting April 1, 2017 through the present.”
