Madison Seating, LLC and an individual owner are facing a former employee’s claims that the parties failed to pay him the proper minimum, overtime, and spread-of-hours wages.
Madison Seating, LLC and an individual owner are facing a former employee’s claims that the parties failed to pay him the proper minimum, overtime, and spread-of-hours wages. In a proposed collective action, the plaintiff says he was hired at the defendant’s chair refurbishment store as a repairman in December 2003 and worked approximately 91 hours per week until May 2016. From this point, he allegedly began working 65 hours per week until the end of his employment in November 2017.
According to the complaint, the plaintiff was paid a flat weekly fee of $750 regardless of how many hours he worked. As a result, the suit alleges, his pay before May 2016 fell below the minimum wage and, throughout his employment, failed to include time-and-a-half premium wages for the hours he worked above 40 each week.
On top of that, the case claims, the defendants neglected to keep accurate time records of employees’ hours and never provided them with required wage statements and notices.
