NYC Green Transportation Group, LLC and NuRide Transportation Group, LLC are on the receiving end of a proposed class action lawsuit that accuses the defendants of failing to properly compensate their employees. The plaintiffs claim they are drivers for the New York City taxi companies – which do business as “Go Green” and “La Puma” – but are not paid for all their hours worked. According to the complaint, the defendants “engage in a willful and deliberate policy and practice” of reducing the number of hours on employees’ paychecks, many times by more than 20 hours, and denying them some of their earned straight-time and overtime wages.
On top of that, the suit argues, the defendants tell employees the companies cannot pay every driver each week and that they choose “at random” which drivers will be paid for each pay period. The plaintiffs say they are instructed to report to their employers’ headquarters to receive their checks and often wait hours – time for which the suit says they are not paid – only to be told that their paychecks are “not ready.”
The complaint further accuses the defendants of requiring employees to work through meal breaks and failing to provide them with accurate wage statements. Even worse, the plaintiffs insist that the defendants began in December 2017 to classify employees as independent contractors “in apparent effort to avoid liability” for the alleged wage violations.
