Two former employees of New York's Sarge’s Deli have filed suit against the operating company and an individual owner of the business claiming they failed to pay workers proper wages and provide required wage documents.
Two former employees of New York's Sarge’s Deli have filed suit against the operating company and an individual owner of the business claiming they failed to pay workers proper wages and provide required wage documents. Citing alleged violations of the Fair Labor Standards Act and New York state labor laws, the suit argues that the plaintiffs and similarly situated employees, despite working more than 60 hours per week, did not receive time-and-a-half overtime pay for the weekly hours they worked above 40. The plaintiffs further allege that they were not paid New York’s mandated minimum wage and were not eligible to have a tip credit taken on their pay since the defendants’ supposedly failed to provide notice that their wages would be partially earned through customer tips.
The suit additionally accuses the defendants of neglecting to supply its employees with wage statements detailing their hours and pay rates, as well as notices informing them of their rights under federal and state labor laws.
