Two former employees of Newark, New Jersey’s Paleio Bar & Grill have filed suit against the restaurant’s operating company and an individual owner claiming that they were not paid for their full hours worked or their overtime hours. The plaintiffs allege that they regularly worked at the restaurant for more than 40 hours per week and should have received time-and-a-half overtime compensation for the weekly hours they worked above 40. The suit argues, however, that the plaintiffs were paid a fixed salary regardless of how many hours they worked and that they were sometimes only paid in tips. The complaint further claims that employees were never granted any rest periods and that the defendant failed to accurately record their hours worked.
