The operating company of Mezcal Grill and Bar and two individuals are on the receiving end of a lawsuit that claims they refused to pay an employee for any of the hours he worked and fired him in retaliation for complaining about their denial of overtime wages. The plaintiff says he worked for the defendants for seven days and attempted to collect overtime wages for the hours he worked above 40. One of the individual defendants allegedly informed him that the restaurant did not pay overtime wages – and the plaintiff was supposedly fired after arguing with him. According to the suit, the defendants then refused to pay the plaintiff for any of the hours he worked, including his straight-time rate and tips.
