Florida
F.A.S.T. Global Marketing, Inc., Marketstorm Global, Inc., and their respective presidents are facing a proposed collective action filed by a former employee who claims he was paid no wages at all for his four weeks of employment. The man says he was responsible for working in various retail locations selling subscriptions to Xfinity services and was told he would be paid only in commissions. According to the case, he worked an average of 93 hours per week without receiving any pay, a violation of the Fair Labor Standards Act’s (FLSA) minimum and overtime wage requirements.
The suit argues that the plaintiff did not supervise other employees, did not make “decisions of importance” on behalf of the defendants, and “was not required to possess any advanced training, skill, or prolonged education” in order to perform his job, meaning he didn’t fall under any FLSA exemptions.
Before filing this case, the plaintiff allegedly demanded that the defendants pay him his due wages and was given a check for only $500.00, which he claims is well below the amount he is owed.
