Lawsuit: Kindred at Home Failed to Keep Track of Employees’ OT Hours

A former employee has filed suit against Kindred Healthcare, Inc. and Kindred Healthcare Operating, Inc. (which does business as Kindred at Home) over claims that the defendants failed to properly compensate employees.

A former employee has filed suit against Kindred Healthcare, Inc. and Kindred Healthcare Operating, Inc. (which does business as Kindred at Home) over claims that the defendants failed to properly compensate their home health licensed practical nurses (LPNs) and physical therapist assistants (PTAs). The plaintiff claims she often worked more than 50 hours per week without receiving premium time-and-a-half wages for the hours worked over 40.
According to the suit, LPNs and PTAs are responsible for providing health services to clients in their homes and were paid per visit. The plaintiff argues that she and other employees would often spend a significant amount of time on activities outside of these visits, such as traveling between patients; transporting samples and medical supplies; completing paperwork; and making phone calls. The defendants allegedly neglected to record time spent on these activities, which the suit says would cause employees’ hours to exceed 40 per week, and therefore failed to pay employees for all their overtime hours.
