Lawsuit: Fleetcor Technologies ‘Turned a Blind Eye’ to Unpaid Off-the-Clock Work

A lawsuit filed in Georgia claims Fleetcor Technologies intentionally failed to pay inside sales reps time-and-a-half overtime wages.

An inside sales representative for Fleetcor Technologies Operating Company, LLC has filed a proposed collective action against his employer that alleges he and similarly situated employees routinely work overtime without proper time-and-a-half hourly pay.
The plaintiff notes he and proposed collective members are paid hourly, plus weekly commissions based on how many gallons were charged to fuel cards they sold. The lawsuit, filed in Georgia, alleges Fleetcor violated the Fair Labor Standards Act (FLSA) by allowing its more than 350 inside sales representatives to work in excess of 40 hours per week to meet sales quotas despite reportedly being told by managers during the hiring process that the position was “not a 40 hour per week” role.
“In the beginning of [the plaintiff’s] employment, [Fleetcor] simply did not have any formalized structure or system to track and record [the plaintiff’s] work hours or those of other inside sales representatives,” the lawsuit claims. “Inside sales representatives were instructed to keep timesheets manually, but were also instructed to not record any more than forty hours per week, regardless of the actual hours worked. [The plaintiff] and other inside sales representatives were instructed to record a 1 hour lunch period regardless of whether they actually took a lunch break.”
