A former employee of oil and natural gas company Kryptonite Energy Services is seeking to recover allegedly unpaid wages.
A former employee of oil and natural gas company Kryptonite Energy Services is seeking to recover allegedly unpaid wages in a proposed class and collective action out of Pennsylvania federal court.
The plaintiff worked for the company as an hourly field employee from January to March 2018 and was responsible for duties that included generator maintenance and driving and loading pickup trucks, the case says. The suit charges the man was not appropriately paid for all time spent working, including overtime hours that allegedly should have been compensated at a time-and-a-half hourly rate. As explained in the complaint:
“Specifically, Plaintiff would work approximately 200 to 210 hours per bi-weekly pay period. On average, Plaintiff’s hours would be cut anywhere from 40 to 60 hours per pay period, and Plaintiff was not paid for these hours even though he performed work for Defendant.”
The plaintiff claims he “complained about his pay issues to many of his superiors, but they did not remedy their failure to pay him for all hours worked.”
