Downtown Towing Company and three individual employers at the company are on the receiving end of a lawsuit that alleges labor law violations.
Downtown Towing Company and three individuals considered employers at the company are on the receiving end of a lawsuit that alleges the defendants routinely failed to pay the plaintiff, an employee of 13 years, overtime wages.
The plaintiff, who worked approximately 45-50 hours per week from July 2004 through July 2017, alleges that the defendants were aware of her work schedule and pay rate, yet failed to pay her time-and-a-half overtime for hours worked in excess of 40 each week. The Fair Labor Standards Act legally obligates employers to pay non-exempt employees at a rate of time and a half their regular rate should they work more than 40 hours per week, the suit says. The case claims that not only did the defendants fail to pay the lawful time-and-a-half rate, they also failed to pay the plaintiff and other employees for any overtime hours worked at all.
