F S Property Maintenance, Inc. and an individual owner are facing a former employee’s claims that he was not paid overtime wages as required by the Fair Labor Standards Act. The plaintiff, who the defendants employed as a laborer and then manager, alleges he was denied time-and-a-half premium pay for all the hours he worked above 40 each week and was instead paid no wages for those hours. He says employees were sometimes required to work on weekends and were paid a fixed amount by a separate check for their weekend work, which the suit argues was the defendants’ attempt to avoid paying them overtime wages.
