A former employee of Edge Fitness, LLC has filed suit against the company over claims that it failed to pay her proper overtime wages. The plaintiff worked for the defendant as a Membership Advisor for at least 45 hours per week without receiving any overtime pay, the case alleges. According to the suit, she was paid a yearly salary and received commissions but was improperly classified as exempt from overtime.
In 2017, the defendant supposedly changed its pay structure and began paying the plaintiff overtime wages but, according to the suit, unlawfully failed to include her commissions in its overtime calculations.
