Four former employees of Mr. Broadway have filed suit against the New York restaurant’s operating company and two individuals over claims that they violated several provisions of the Fair Labor Standards Act and New York Labor Law.

Four former employees of Mr. Broadway have filed suit against the New York restaurant’s operating company and two individuals over claims that they violated several provisions of the Fair Labor Standards Act and New York Labor Law. The plaintiffs allegedly worked at the kosher eatery as delivery workers without being paid proper minimum, overtime, or spread-of-hours wages. They claim the defendants paid them less than minimum wage but did not inform them that their tips were being included as an offset for wages. On top of that, the suit alleges, the defendants required them to spend 20 percent of each shift performing non-tipped duties and withheld a portion of their tips each week.
The plaintiffs further attest that their paystubs were adjusted to reflect a fewer number of hours, and they were allegedly never reimbursed for purchasing “tools of the trade,” such as bicycles, bicycle accessories, helmets, gloves, and outerwear.
One of the plaintiffs also claims he was not paid at all for his last week of employment and is owed his due wages.
