A fmr. delivery person claims NY's Union Square Wine & Spirits owes unpaid overtime wages and costs related to on-the-job parking tickets.
A proposed collective and class action filed in New York claims 33 Union Square West, Inc., which does business as Union Square Wine & Spirits, and its owner owe unpaid overtime wages under the Fair Labor Standards Act (FLSA). The plaintiff, who the complaint says worked as a delivery person for the defendants from June 2015 through August 2017, alleges he worked between 41 and 49 hours per week without being paid mandatory time-and-a-half hourly wages for all hours worked beyond 40 each week. The case further claims the defendants employed an unlawful policy of deducting the costs of parking tickets from delivery drivers’ wages. According to the plaintiff, the defendants never reimbursed him for $250-$300 in parking fines, which the case categorizes as “work-related expenses.”
