Lawsuit Claims Rice Energy Owes Day-Rate Workers Unpaid Overtime
Last Updated on May 8, 2018
Phillips v. Rice Energy, Inc.
Filed: August 31, 2017 ◆§ 2:17-cv-01150-DSC
A proposed class action filed at the end of August claims Rice Energy has failed to pay day-rate workers proper time-and-a-half overtime wages.
A proposed class/collective action filed against oil and natural gas drilling outfit Rice Energy, Inc. claims the company owes unpaid overtime to day-rate workers. The lawsuit, filed in Pennsylvania, alleges proposed class members routinely worked more than 40 hours per week between August 2014 and August 31, 2017 (the filing of this lawsuit) but were not paid time-and-a-half hourly premiums for all hours worked past 40 during those workweeks. At issue, the complaint argues, is that the defendants misclassified proposed class members as independent contractors exempt from overtime pay, rather than as employees subject to state and federal overtime protections.
