The owners and operators of two Alidoro sandwich shops are facing a proposed collective action filed by six current or former employees who claim they weren’t paid in accordance with state and federal law.

According to the lawsuit, the plaintiffs worked for the Manhattan restaurants as delivery workers and were paid a tip-credited hourly rate. The case claims they should have been paid the full minimum wage instead, as they were never notified of the tip credit and were required to spend at least 20 percent of each day performing non-tipped tasks unrelated to their delivery duties. Further, the plaintiffs allege they are owed portions of their credit card tips that the defendants unlawfully withheld.
The lawsuit additionally argues that delivery drivers weren’t provided with proper meal breaks and were never reimbursed for purchasing items and services required to perform their jobs, such as bicycles, a MetroCard, bike maintenance, a helmet, a vest, and other supplies.
