Lawsuit Claims Hannaford Fails to Pay Department Managers Proper Overtime

Per a lawsuit, the company that runs the Hannaford supermarket chain owes department and assistant dept. managers unpaid overtime wages.
Hannaford Bros. Co., LLC is the defendant in a proposed class and collective action that alleges the company fails to pay proper overtime wages to department managers and assistant department managers at its supermarkets nationwide. The plaintiff, a former produce and then bakery department manager from 2004 through March 2017, claims the job duties of salaried department managers, despite their job titles, did not include hiring, firing, disciplining, directing the work of others, or any other tasks that would exempt the workers from overtime pay.
According to the lawsuit, despite uniformly increasing the salaries of proposed class members around December 1, 2016 to “at or above the minimum salary threshold for claiming exempt status” as per the Department of Labor’s then-new overtime rule, the defendant did not perform an analysis of the employees’ job duties when it made this payroll decision. The case alleges Hannaford Bros. simply “did not provide sufficient money in the labor budgets to cover all hours needed to complete the necessary manual and non-exempt tasks in each store.”
