Clay County, AK is staring down a lawsuit claiming those employed by the county as jailers within the last three years are owed unpaid overtime wages.
Clay County, Arkansas is staring down a proposed class and collective action in which the plaintiff claims those employed by the county as jailers within the last three years are owed unpaid overtime wages.
Citing potential violations of the Fair Labor Standards Act (FLSA) and the Arkansas Minimum Wage Act, the case says the plaintiff and other jailers were routinely required to work in excess of 40 hours each week. The plaintiff claims that detention center employees often worked upward of 171 hours across a 28-day period.
Clay County allegedly knew jailers were working more than 40 hours per week yet knowingly failed to pay the employees proper time-and-a-half wages, the suit states.
