A proposed collective action claims American Family Care does not pay clinic managers overtime to reduce overall payroll costs.
American Family Care, Inc. is on the receiving end of a proposed collective action in which the plaintiff claims the urgent care center company failed to pay its clinic managers any overtime compensation. Citing possible violations of the Fair Labor Standards Act (FLSA), the plaintiff charges the defendant, who operates more than 65 urgent care centers across four states, declines to pay clinic managers overtime as a way of reducing companywide payroll costs. The lawsuit argues that contrary to the defendant’s position, clinic managers are not bona fide executives with true managerial responsibilities, as they spend the majority of their work time “primarily acting as floaters performing the work of hourly paid employees, engaging in customer service, and performing other non-management tasks.”
