A former employee claims in a proposed collective action that All American Oilfield, LLC has failed to pay workers proper overtime wages.
All American Oilfield, LLC faces a proposed collective action in which a former employee claims the Alaska-based oilfield services provider has failed to pay workers proper overtime wages.
According to the case, employees were paid on a day rate basis without receiving time-and-a-half overtime pay for every hour worked over 40 each week.
“As the result of Defendant’s failure to pay overtime premium compensation for all hours worked over forty (40) in a workweek, Defendant is liable to Plaintiff for damages including backpay, liquidated damages, and Plaintiff’s costs and attorneys’ fees,” the lawsuit claims.
The suit alleges All American Oilfield’s workers are non-exempt employees who often put in more than 40 hours of work per week and were not compensated on a salary or fee basis. Nonetheless, the defendant failed to pay the workers premium wages for their overtime hours, according to the case.
Moreover, the lawsuit argues that All American Oilfield failed to maintain and preserve payroll records that accurately display the hours worked by employees on a daily and weekly basis as required under the Fair Labor Standards Act.
The suit looks to represent all current and former non-exempt employees of the defendant who were paid on a day rate basis without receiving proper overtime premium wages for all hours worked over 40 in a workweek.
