Burger Maker, Inc. and Schweid and Sons South, LLC are facing a proposed class action filed by a former employee of the defendants’ meat processing and supply business who claims she and other supervisors weren’t paid properly.

Burger Maker, Inc. and Schweid and Sons South, LLC are facing a proposed class action filed by a former employee of the defendants’ meat processing and supply business who claims she and other supervisors weren’t paid properly. The plaintiff says she worked as a “Grind Supervisor” at the defendants’ College Park, Georgia production plant and was responsible for operating machinery, packaging meat, and cleaning. Though the woman and others were allegedly paid a yearly salary and given supervisor titles, the lawsuit argues that their primary duties were manual in nature; required “little skill and no capital investment”; and didn’t involve managerial responsibilities such as exercising independent judgment and hiring or firing employees. Therefore, the case argues, supervisors should have been classified as non-exempt and paid overtime wages for the hours they worked above 40 each week.
