Lamberto Fermin v. Blue Moon Hotel Limited et al
Filed: February 5, 2018 ◆§ 1:18cv769
Blue Moon Hotel Limited, International Students Residence Inc., and an individual owner are on the receiving end of a proposed collective action filed by a woman who claims she never received overtime while working for the defendants as a housekeeper.
New York
Blue Moon Hotel Limited, International Students Residence Inc., and an individual owner are on the receiving end of a proposed collective action filed by a woman who has worked as a housekeeper at the defendants’ two Brooklyn hotels since March 2014. The plaintiff says she often works more than 40 hours per week but is not paid time-and-a-half premium wages for the hours she works above 40. On top of that, the case alleges, the defendants don’t keep an accurate record of her hours worked and sometimes don’t compensate her for all of them, causing her pay to fall below minimum wage.
The plaintiff further argues that she has used her own funds to purchase “tools of the trade” – including four pairs of shoes and a cleaning brush – without being reimbursed.
