Twenty-five Just Salad operating companies and the chain’s individual owner has been hit with a proposed class and collective action filed by 13 plaintiffs who allege they and similarly situated workers were paid less than minimum wage.
The case looks to cover those who worked for Just Salad between September 1, 2017 and the present. According to the lawsuit, Just Salad, among other alleged wage and hour abuses, unlawfully retained the entire $1.99 delivery fee—which the case points out is advertised to customers as a tip designated for delivery workers—on orders placed with a credit card or through Seamless or GrubHub. Further, the plaintiffs claim Just Salad failed to give employees enough t-shirts, which they were required to wear, and thereby forced the individuals to launder their mandatory work uniforms at their own expense.
Further still, the plaintiffs allege Just Salad forced delivery workers to contribute tips to a tip pool that was used to cover the cost of delivery orders that were not paid for.
