Three former employees claim Time Square's Hard Rock Cafe fails to pay proper wages and all group party/private event gratuities.

Three plaintiffs formerly employed by the Hard Rock Café in Times Square in New York City have filed a proposed class action against the restaurant’s operating company over a slew of alleged Fair Labor Standards Act (FLSA) violations. The lawsuit against defendant Hard Rock Café International (USA), Inc. alleges the company not only engaged in the policy and practice of requiring employees to work off the clock, but unlawfully:
- Failed to pay time-and-a-half overtime for all hours worked past 40 each week;
- Failed to pay employees spread-of-hours wages (equal to one additional hour of pay) for shifts lasting longer than 10 hours in a day;
- Failing to properly issue to employees the entire gratuity obtained from group and private events;
- Failing to provide workers with mandatory wage notices; and
- Failing to reimburse employees for business expenses related to the laundering and maintenance of work uniforms.
