Lawsuit Alleges Intrepid USA Healthcare Services Owes LPNs Unpaid Overtime

Home health workers, such as licensed practical nurses, are owed unpaid OT for time spent traveling to patients' homes and other activities, a lawsuit says.
Kentucky
Intrepid U.S.A., Inc. and F.C. of Kentucky, Inc., which operate as Intrepid USA Healthcare Services, find themselves as the defendants in proposed class and collective action that seeks to recover allegedly unpaid overtime wages. The lawsuit aims to challenge the defendants’ alleged practice of not paying time-and-a-half overtime wages to home health workers, such as licensed practical nurses, for hours worked past 40 each week. Despite paying home health workers a per-visit fee and hourly wages for meetings and other office-based work, the defendants, the lawsuit claims, allegedly failed to pay proposed class members for time spent:
- Traveling between patient home visits;
- Transporting samples to labs;
- Delivering medical supplies to patients’ homes;
- Completing patient charts and other paperwork;
- Calling patients and healthcare professionals regarding patient care; and
- Answering phone calls from patients.
The plaintiff notes in the complaint she’s often worked 70 hours per week without proper wages. Further, the case states the defendants were sued by their employees in 2014 over the same supposed Fair Labor Standards Act (FLSA) violations.
