A lawsuit filed in Pennsylvania claims Bos Solutions improperly classified employees as independent contractors and owes unpaid overtime wages.
A proposed class/collective action claims solid/liquid waste separation company Bos Solutions, Inc. failed to pay certain employees proper wages in violation of both Ohio and Pennsylvania laws, as well as the federal Fair Labor Standards Act (FLSA). The plaintiff, who formerly worked for the defendant as a solids control technician from January 2014 through June 2015, claims he and similarly situated workers were paid a day-rate and improperly classified as independent contractors, rather than employees, without being paid proper time-and-a-half overtime for all hours worked over 40 each workweek.
The case covers a proposed class of current and former Bos Solutions oilfield workers who were classified as independent contractors and paid at a day-rate within the last three years.
