Lawsuit Against Tokyo Japanese Restaurant Seeks to Recover ‘Improper Deductions’ from Servers’ Checks

Two former waitresses claim Tokyo Statesboro GA, LLC took improper deductions from employees' tips, among other alleged labor law violations.
Two former waitresses have filed a lawsuit against Tokyo Statesboro GA, LLC, which operates Tokyo Japanese Restaurant in Statesboro, Georgia, and its owner to recover allegedly unpaid regular and overtime wages in addition to “improper deductions” taken from their paychecks. According to the lawsuit, the plaintiffs and similarly situated employees were “required to sign-over checks” made out to them directly back to the individual defendant on a regular basis. Upon information and belief, the case says, the defendants took these improper deductions from employees’ tips. The plaintiffs say that as a result of the defendants’ improper deductions, their compensation was limited only to tips received from customers.
“[The defendants] failed to properly calculate the minimum wage tip-deduction from the federal and state minimum wage for each regular and overtime hour paid to its waiters and waitresses,” the lawsuit alleges.
The plaintiffs claim they’re each owed more than $25,600 in unpaid regular and overtime wages.
