A proposed collective action alleging labor law violations has been filed against the company and individual who operate Quality Services Moving in Virginia. The plaintiff in the case says she worked for the defendants as a mover, responsible for driving moving vans, loading, unloading, and preparing trucks for shipments. Citing potential Fair Labor Standards Act violations, the woman claims she and other movers were required to work off the clock without getting paid. Specifically, the case alleges, they were asked to report to the defendants’ headquarters at 7:00 a.m. but had to wait for administrators to arrive and assign them jobs before they could begin working – time for which they were not paid despite being “required to be there.”
On top of that, the suit continues, the plaintiff and others were not paid for the time it took them to prepare their vans and to drive from moving sites back to headquarters after each shift to return the vehicles. The plaintiff further argues that movers were not paid for their actual time spent driving when their hours exceeded “the amount of pay set by the company for the particular distance driven.”
