CVK Restaurant Corp. and two individuals who operate Murray Hill Diner are facing a proposed collective action filed by a former dishwasher and delivery worker who claims he was not paid proper wages.

CVK Restaurant Corp. and two individuals who operate Murray Hill Diner are facing a proposed collective action filed by a former dishwasher and delivery worker. The plaintiff, who worked for the defendants between September 2014 and November 2017, claims he worked more than 40 hours per week without being paid proper minimum, overtime, and spread-of-hours wages. According to the complaint, he was given a fixed weekly salary that never varied with the number of hours he worked. The defendants allegedly required him to arrive at work 30 to 45 minutes early without compensation and rarely allowed him to take a meal or rest break, the suit says.
On top of that, the plaintiff alleges the defendants had him sign false pay receipts reflecting that he worked fewer than 40 hours and was paid $12 per hour.
He further claims that he was never reimbursed for purchasing “tools of the trade” at his own expense, including five bicycles, three helmets, six chains, more than 12 sets of lights, and the cost of bicycle maintenance and repair.
