A wage and hour case against Georgia Championship Barbeque Company gets into allegations of competition winnings that have gone unreported to the IRS.

Georgia Championship Barbeque Company and one individual with operational control of the restaurant are the defendants in a proposed collective action filed by three former employees who claim they worked 58 hours per week without proper overtime pay. Citing potential Fair Labor Standards Act (FLSA) violations, the lead plaintiffs allege they were required to arrive at the defendants’ Stockbridge, Georgia eatery 30 minutes earlier than their shift start times, as well as stay one hour and 30 minutes after closing time to clean up. As a result, the complaint says, the plaintiffs generally worked 58 hours per week without proper wages or bona fide lunch breaks. All told, the lawsuit estimates the three plaintiffs are owed a combined $75,466 in unpaid wages.
Coupled with the plaintiffs’ unpaid wage allegations are claims that Georgia Championship Barbeque Company receives “thousands of dollars each year” in barbecue competition winnings and from private catering and hospitality services that the defendants do not report to the Internal Revenue Services as income.
