Eight current and former security advisors have filed suit against Defenders, Inc. over claims that the company failed to pay them properly. The plaintiffs are/were reportedly responsible for installing and servicing alarm systems for the defendant’s customers and were paid per job completed. The problem, the suit suggests, is that the workers’ pay didn’t include compensation for time spent traveling to each job location and for attending “lengthy” mandatory meetings at the defendant’s branch offices that would often last “several hours.” On top of that, the complaint adds, the defendant’s pay structure allegedly failed to account for time spent on installation jobs for customers who refused to complete their orders.
The case argues that by neglecting to properly record all the time employees spent working, the defendant miscalculated the “regular rate of pay” used to determine their overtime rates and underpaid them as a result.
