Three California electricians who worked for the City of San Diego have filed a proposed class action lawsuit that claims their overtime wages were miscalculated.
Three California electricians who worked for the City of San Diego have filed a proposed class action lawsuit that claims their overtime wages were miscalculated. According to the complaint, the plaintiffs participated in a benefits plan that provided a specified amount of money each year – “flex dollars” – to be used for the purchase of health benefits. The suit argues that the defendant failed to account for this extra money when determining the regular rate of pay used to calculate each employee’s time-and-a-half overtime wages, causing the workers to be underpaid.
