Las 3K USA Hit with Ex-Maintenance Worker’s FLSA Lawsuit

Las 3K USA has been accused of failing to pay proper overtime wages.
An individual who performed maintenance work for Las 3K USA, L.L.C. has sued the restaurant operating company and its owners to recover allegedly unpaid wages. The plaintiff, who worked for the defendants’ Que Chulada and El Capo Brickell locations in Miami from April to December 2017, claims that in addition to his maintenance duties, he was also asked to fill in for absent co-workers, often stepping in as a busboy, server or cook. According to the complaint, the plaintiff put in six or seven days of work per week, many times working nearly 70 hours, without proper minimum wages for all hours worked. The case claims the plaintiff was paid $700 per week regardless of the number of hours he truly worked.
“Based upon the number of hours worked and the amount of compensation he received each week, [the plaintiff’s] regular rate of pay fell below the Florida minimum wage,” the lawsuit asserts.
