Langston Companies, Inc. finds itself as the defendant in a lawsuit filed by a former employee who claims he is owed unpaid wages.
Langston Companies, Inc. finds itself as the defendant in a proposed collective and class action filed by a former employee who claims he is owed unpaid wages.
According to the case, the plaintiff was employed as an hourly paid factory worker for the defendant, a “leading supplier” of bags and packaging products. The suit claims that the plaintiff and other employees were required to use an electronic timekeeping system that rounded their clock in and clock out times in the company’s favor. As explained in the complaint:
“For example, if an hourly-paid employee clocked in at 7:45 am, the payroll system recorded his or her start time as 8:00 am. Likewise, if an hourly-paid employee clocked out at 5:15 pm, Defendant's payroll system recorded his or her end time as 5:00 pm.”
The plaintiff alleges this inaccurate system “[r]esulted in several hours of unpaid work each month,” some of which were overtime hours that should have been paid at the required time-and-a-half rate.
