Site Services Group, Inc. and its owner/operator have been hit with a proposed class and collective action alleging violations of federal and New York state wage laws. The plaintiff, who was employed by the defendants as a landscaper, says he worked about 72 hours per week but was not paid overtime for all hours worked beyond 40 each workweek. In addition, the plaintiff claims he didn’t receive accurate wage statements from the defendants detailing his hourly rate, overtime hours, gross income, deductions, and net wages as required by law. The suit also claims the defendants did not follow their contracts with the Suffolk County Water Authority, resulting in a loss of prevailing wages and benefits to the plaintiff. Lastly, the suit alleges the plaintiff had to spend $1,500 in legal expenses stemming from a ticket he received on the job that the owner defendant said he “would take care of.”
