The operating companies and owners of Lalu Deli Grocery are the defendants in a former employee’s lawsuit in which the man claims he was not paid the required minimum wage and was also deprived of proper overtime wages.
The plaintiff put in 60 hours of work per week as a delivery worker at the Manhattan deli, the suit says. The man claims that regardless of the number of hours put in, he received a fixed weekly salary that failed to meet the minimum wage for each hour worked.
Additionally, the plaintiff claims that he received an improper tip-credited wage because he spent a significant part of his workdays performing non-tipped duties, including placing store orders, stocking inventory and cleaning. Further, the case alleges the man was never notified that a tip credit would be applied to his wages, a violation of federal labor law.
The complaint goes on to claim that the defendants deprived the plaintiff of accurate paystubs throughout his employment and regularly failed to pay the man on his scheduled pay day. The suit also alleges the defendants did not uphold any time-keeping practices and failed to reimburse the plaintiff for a bicycle that he was required to buy and maintain to perform his job.
