The companies that operate three La Gata Golosa Columbian restaurant and bakery locations in New York City are on the wrong side of a proposed collective action filed by three former employees who claim they’re owed unpaid wages. The complaint says that although the plaintiffs were ostensibly employed as waitresses, the defendants required them to spend more than 20 percent of their workdays performing non-tipped tasks, such as cooking and cleaning. To this claim, the lawsuit states the defendants—The Twin Kitty Bakery Corp.; Two Brothers Bakery Corp.; Sweet Kiss Corp.; 8263 Bakery Corp.; and four individual owners—“disguised” the plaintiffs’ true job duties in payroll records to avoid paying them at the full hourly minimum wage rate.
The complaint also alleges the defendants failed to provide employees with meal or break periods; notice that their wages were offset by a tip credit; and reimbursement for spending their own money to purchase mandatory work shirts.
