A lawsuit filed in Kentucky claims Good Shepherd Healthcare Solutions, aka BrightStar of Kentucky, owes workers unpaid overtime wages.

A Louisville, Kentucky woman alleges in a proposed class action that Good Shepherd Healthcare Solutions, Inc., which operates as BrightStar of Kentucky, a home care provider, failed to pay its employees proper overtime wages. The plaintiff, an in-home caregiver, claims she worked more than 90 hours in some weeks without being paid at the time-and-a-half hourly overtime rate for all hours worked past 40.
The case further claims the defendant was not concerned with the Fair Labor Standards Act’s overtime provision until after the U.S. Department of Labor’s 2015 ruling that allowed home care industry workers to receive overtime. Once the ruling was in place, the defendant, the case claims, “implemented a scheme to evade the payment of overtime” by paying its in-home workers a predetermined hourly rate for all hours worked, including hours worked past 40. As part of its alleged scheme, the defendant supposedly submitted to its paycheck processor “misleading information” regarding its workers’ hourly rates.
