Kurry Pavilion Employees File Suit Over Unpaid Wage Claims

A group of current or former employees of Curry Shack Corp. filed suit against the restaurant and an individual with control of the business claiming they were not paid proper wages or provided with accurate wage statements and notices.
Back in September, a group of 15 current or former employees of Curry Shack Corp. filed suit against the restaurant and an individual with control of the business claiming they were not paid proper wages or provided with accurate wage statements and notices. The plaintiffs say they worked at the defendants’ Indian restaurant Kurry Pavilion as servers, food runners, an assistant to the manager, cooks, kitchen helpers, dishwashers and delivery workers. Though they worked more than 40 hours per week, the suit says, they were allegedly not paid proper minimum, overtime, or spread-of-hours wages.
The tipped employees claim they were required to perform non-tipped duties for more than 20 percent of each day, meaning the defendants were not permitted to apply a tip credit to their wages.
On top of that, the plaintiffs allege that there were certain periods of their employment for which they were paid no wages at all. One plaintiff says the defendants “harassed” him by “calling him names and teasing him about the money they had not paid him.”
Furthermore, many of the plaintiffs argue that they have still not been reimbursed for purchasing “tools of the trade,” including uniform items, a bicycle, and its various accessories.
