Five former or current employees of Kira Sushi 2, LLC have filed suit against the restaurant and four individual owners claiming the parties denied them proper wages.
Five former or current employees of Kira Sushi 2, LLC have filed suit against the restaurant and four individual owners claiming the parties denied them proper wages. The plaintiffs were allegedly employed as delivery men and say they spent more than 40 hours per week working for the defendants without receiving proper time-and-a-half overtime wages for the hours they worked above 40, in direct violation of federal law.
According to the suit, the defendants withheld approximately $50 to $60 per week from each of the plaintiffs’ tips and denied them uninterrupted rest breaks, causing their pay to fall below the minimum wage. Furthermore, the plaintiffs claim they spent more than 20 percent of each day performing non-tipped activities and were required to spend their own money on “tools of the trade” – including gasoline, vehicle maintenance and repair, and parking/traffic tickets – without reimbursement.
