A woman formerly employed as a home health aide by Kare Management Solutions, LLC has filed a proposed collective action against the company to recover supposedly unpaid overtime wages. The plaintiff, a Virginia resident, claims she worked as a Certified Nursing Assistant for the defendant between September 2015 and January 2018. According to the complaint, the woman put in between 50 and 70 or more hours per week without time-and-a-half pay for every hour worked beyond 40. The lawsuit says the plaintiff and similarly situated workers’ timesheets routinely reflected that they worked beyond 40 hours per week, yet the defendant paid only straight time for hours worked in excess of 40 instead of premium overtime pay.
