Long Beach, NY restaurant JR Asian Fusion is staring down allegations it failed to pay proper minimum and overtime wages.
A proposed class action alleges JR Fusion, Inc., which does business as Long Beach, New York restaurant JR Asian Fusion, and one individual with control of the business are responsible for unpaid minimum and overtime wages. The plaintiff, a former waiter who also helped out with cleaning and food preparation, alleges he worked roughly 67 hours per week and was paid a flat cash rate—$400 per month, according to the complaint—regardless of the number of hours he worked each week. Moreover, the man claims he received in the neighborhood of $100 in tips per day, of which at least eight percent of tips placed on credit cards were deducted by the defendants.
In addition to citing potentially wage and hour violations of the Fair Labor Standards Act (FLSA), the case claims the defendants also violated New York’s’ state labor law by failing to pay the plaintiff spread-of-hours wages—one additional hour’s pay at the minimum wage—owed for shifts that last longer than 10 hours in a day.
