Palm Springs watering hole Johnny Q’s restaurant and sports lounge and its owner are the defendants in a proposed class action in which the plaintiff, a former cook, claims he’s owed unpaid overtime wages. The plaintiff, who the case says worked for the defendants from December 2013 through November 2017, claims he would work an average of 15 overtime hours during certain pay periods without being paid time-and-a-half hourly premiums for each hour worked past 40. For example, when the plaintiff worked more than 40 hours in a week, the complaint says, the defendants would allegedly only pay him for 20 hours of work on a W-2 check, with the rest of the time compensated for in cash or by personal check.
