(which does business as Joe Asian & Sushi) and three individual owners are facing a former employee’s proposed collective action that alleges violations of federal and state labor laws. The man claims he worked at the defendants’ restaurant as a deliveryman and was paid a fixed salary of $1,700.00 per month regardless of how many hours he worked. According to the suit, this sum amounted to less than the minimum wage per hour and failed to include premium overtime and spread-of-hours pay for the hours the plaintiff worked in excess of 40 per week and 10 per day.
