Jack’s Egg Farm and its two individual owners are on the receiving end of a proposed collective and class action filed in New York by two former employees over alleged wage violations.
According to the complaint, the plaintiffs were employed as a truck driver and a driver’s assistant, respectively, by the Brooklyn-based food products supplier. The men say they worked at least 60 hours each week for fixed weekly salaries that did not vary depending on the number of hours put in, causing their effective pay rates to fall below the required minimum wage and depriving them of overtime pay. The plaintiffs further claim that, in violation of New York law, they did not receive spread-of-hours pay for days in which they worked over 10 hours.
Adding to the case’s wage allegations, the suit accuses the defendants of failing to issue proper wage notices and unlawfully adjusting the plaintiffs’ wage statements “so that they reflected inaccurate wages and hours worked.” Moreover, the defendants supposedly failed to reimburse the workers for “tools of the trade,” such as gloves and boots, the case says.
